Terms of Service

1. Acceptance of Terms

These Terms of Service (the "Terms") govern your access to and use of the SerenityNow platform and related services (the "Service") provided by SerenityNow, Inc. ("SerenityNow," "we," "us," or "our"). By creating an account, making payment, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you may not access or use the Service.

2. Description of the Service

SerenityNow provides AI guided divorce and coparenting mediation tools designed for cooperative matters in which both participants intend to reach a written agreement. The Service supports two products: a whole divorce mediation platform and the SerenityNow Family Center for post decree coparenting.

The information and materials provided through the Service are for general educational and informational purposes only.

The Service is intended only for cooperative, agreement reached matters. It is not designed or offered for contested litigation, default judgments, trial track filings, or matters involving domestic violence, and you should not rely on the Service for those purposes.

3. Eligibility and Age Requirements

You must be at least 18 years of age and legally able to enter into a binding contract to use the Service. By using the Service you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.

4. Payment Terms

Access to the Service is provided for a one time flat fee. The Service is not a subscription, and there is no recurring charge, auto renewal, or automatic billing of any kind. Current pricing is five hundred dollars ($500) for a custody plan and one thousand dollars ($1,000) for a full divorce. SerenityNow may change its pricing on a going forward basis, but any change will not affect a fee already paid for a matter in progress.

Refunds. Fees paid for the Service are non refundable. If a technical or service issue prevents you from completing your matter, SerenityNow may, in its discretion, extend your access to the Service for a reasonable additional period so the issue can be resolved.

5. Not Legal Advice

SerenityNow provides AI guided mediation tools and general information only. SerenityNow is not a law firm, does not provide legal advice, and does not act as your attorney. Use of the Service does not create an attorney client relationship. The information and documents generated through the Service are general in nature and may not reflect the law of your jurisdiction or the specifics of your situation. You should consult a licensed attorney for advice specific to your circumstances before relying on or filing any document.

6. Acceptable Use

You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You agree not to:

  • access or attempt to access the Service by any means other than the interface we provide;
  • scrape, crawl, harvest, or index any part of the Service;
  • copy, reverse engineer, decompile, or attempt to derive the source code of the Service;
  • circumvent, disable, or interfere with any security or authentication feature of the Service;
  • impersonate any person or misrepresent your identity or affiliation with any person;
  • upload malicious code or otherwise interfere with the proper operation of the Service;
  • use the Service to harass, abuse, defame, or otherwise harm another person; or
  • resell, sublicense, or commercially exploit the Service without our prior written consent.

7. Threat Policy

During a mediation session, if you direct a threat to the mediator about the other parent, SerenityNow will issue a warning to you on the first instance. A repeat instance will result in removal from the platform.

This policy addresses threats made to the mediator about the other parent specifically. It is separate from and does not override our crisis protocol. If your communications reflect a personal safety crisis rather than a threat about the other parent, the Service will surface safety resources, continue to support you, and your mediation will not be halted.

8. Monitoring and Compliance

SerenityNow may monitor use of the Service to maintain quality, security, and compliance with these Terms, including automated review of session content for safety and policy enforcement. We may suspend or terminate access for any user who violates these Terms or applicable law.

9. Intellectual Property

The Service, including its software, content, design, text, graphics, and trademarks, is owned by SerenityNow or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, SerenityNow grants you a limited, non exclusive, non transferable, revocable license to use the Service for your personal, non commercial use in connection with your own matter. Documents that the Service generates for you and that reflect your own information are yours to use for your matter. All rights not expressly granted are reserved.

10. Feedback License

If you provide SerenityNow with feedback, suggestions, or ideas about the Service, you grant SerenityNow a perpetual, irrevocable, worldwide license, with no royalty owed to you, to use and incorporate that feedback for any purpose without further obligation or compensation to you.

11. Privacy and Data Retention

Your use of the Service is subject to our Privacy Policy. From a completed matter, SerenityNow retains the final signed Shared Custody Plan, the final Memorandum of Understanding (MOU), and the information you keep in the SerenityNow Family Center. Apart from these, no other case data, session content, or intermediate drafts are retained.

The Service uses analytics and advertising measurement tools, including Google Analytics, PostHog, and the Reddit Pixel, as described in the Privacy Policy. These tools receive device and usage information only. They do not receive the contents of your mediation sessions, your matter information, or your documents.

12. Warranty Disclaimer

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, SerenityNow disclaims all warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non infringement. SerenityNow does not warrant that the Service will be uninterrupted or without error, or that any document generated through the Service will be accepted by any court or satisfy the requirements of any jurisdiction.

13. Limitation of Liability

To the fullest extent permitted by law, SerenityNow and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or relating to your use of the Service. SerenityNow's total aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you actually paid to SerenityNow for the matter giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless SerenityNow and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

15. Modification of Terms

SerenityNow may modify these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.

16. Privacy Policy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference.

17. General Terms

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Governing law. These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles.

Dispute resolution. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration in Franklin County, Ohio, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information. All arbitration will be conducted on an individual basis. You and SerenityNow each agree not to bring or participate in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate more than one person's claims or preside over any form of a class or representative proceeding.

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and SerenityNow regarding the Service and supersede any prior or contemporaneous agreements on that subject.

Electronic communications. You consent to receive communications from SerenityNow in electronic form, including by email to the address associated with your account and by notices posted within the Service. You agree that all agreements, notices, disclosures, and other communications SerenityNow provides to you electronically satisfy any legal requirement that such communications be in writing. This does not affect any rights you have that cannot be waived.

Waiver. SerenityNow's failure to enforce any provision of these Terms will not be deemed a waiver of that provision or of any other provision.
